MINDBOLO TERMS OF USE
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING MINDBOLO, ITS WEBSITE, PLATFORM, OR SERVICES.
These Terms of Use ("Terms") govern your access to and use of mindbolo.com, the MindBolo platform and dashboard, AI assistants, and related services made available by Jawad Karim Marketing Services, trading as GetDigital.ae, which operates MindBolo (referred to as "MindBolo," "GetDigital.ae," "we," "us," or "our").
By accessing or using MindBolo, creating an account, starting a trial, or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
If you accept these Terms on behalf of a company or other organisation, you represent that you have authority to bind that organisation. In that case, "you" and "Customer" refer to that organisation and the people authorised to use its account.
MindBolo provides technology tools. It does not provide legal, medical, financial, educational, or other professional advice, and it does not guarantee business results, lead volume, sales, conversions, or customer outcomes.
1. DEFINITIONS

| Platform | The MindBolo software, dashboard, assistant configuration tools, and related technology made available by us. |
| Services | The platform and associated features, including assistant creation and configuration, content-based responses, conversation records, lead capture, analytics, and support features made available under a selected plan. |
| Subscription | A paid or trial plan that provides access to specified features and usage allowances. |
2. THE SERVICES
MindBolo is an AI-powered assistant platform that enables businesses to create, configure, and deploy conversational assistants using their business information. Depending on the plan and features available, the Services may include:
- Creating and configuring AI assistants without requiring custom coding.
- Training or grounding assistants using website content, business documents, FAQs, product and service information, and other supported knowledge sources.
- Customising assistant instructions, behaviour, appearance, and conversation experience.
- Answering visitor questions and supporting customer service and sales conversations.
- Capturing enquiry details and qualifying or categorising leads where those features are enabled.
- Displaying relevant product or service information, including images where supported.
- Providing conversation history, logs, usage insights, and analytics.
- Directing visitors to customer-selected booking pages, WhatsApp, or other available handover destinations.
- Providing account support, product guidance, and platform updates.
The precise features, usage limits, supported content formats, deployment methods, and availability may vary by subscription, configuration, and product version. The current plan description and account dashboard form part of the information governing your selected plan.
We may add, modify, improve, suspend, or discontinue features. Where a change materially affects a paid feature or your contractual rights, we will provide notice where required by applicable law or the relevant subscription terms.
3. ELIGIBILITY AND ACCOUNT REGISTRATION
You must be at least 18 years old and legally capable of entering into a binding agreement to register for and manage a MindBolo account.
When creating an account, you agree to provide accurate, current, and complete information and to keep it updated. You must not impersonate another person, misrepresent your affiliation, or register on behalf of an organisation unless authorised to do so.
You are responsible for maintaining the confidentiality of your login credentials, managing account access, and all activity carried out through your account, except to the extent that applicable law provides otherwise.
Notify us promptly if you suspect unauthorised access, credential compromise, or other security issues involving your account. We may require reasonable steps to verify account ownership before making changes or disclosing account information.
You must not create or use an account if your access has been suspended or terminated for a material breach, unless we authorise you to do so.
4. ACCEPTABLE USE
You may use MindBolo for lawful business and personal purposes consistent with the Services and these Terms. You agree not to use, or permit others to use, the Services to:
- Violate applicable laws, regulations, court orders, or the rights of any person.
- Infringe intellectual property, privacy, publicity, confidentiality, or other rights.
- Upload or distribute malicious code, malware, viruses, or content intended to disrupt or compromise systems.
- Attempt to gain unauthorised access to accounts, systems, networks, data, or platform components.
- Probe, scan, interfere with, overload, or disrupt the Services or their infrastructure, or bypass security or usage restrictions.
- Use the Services for fraud, deception, impersonation, phishing, harassment, threats, or unlawful surveillance.
- Generate or distribute unlawful, abusive, deceptive, or harmful content, or use the Services in a way that violates applicable content or safety requirements.
- Collect personal data without an appropriate legal basis, notice, consent where required, or authority.
- Upload sensitive personal data unless the use case is permitted, necessary, and supported by appropriate legal and security safeguards.
- Reverse engineer, copy, resell, sublicense, or create a competing service from the platform except to the extent such restriction is prohibited by law.
- Misrepresent AI-generated content as verified human review or use the Services to make consequential decisions without the safeguards required by law.
- Use the Services in a manner that materially harms the security, availability, or integrity of MindBolo or other users.
We may investigate suspected misuse and take proportionate action, including warnings, feature restrictions, suspension, or termination, subject to applicable law and any contractual notice requirements.
5. SUBSCRIPTIONS, FEES, AND PAYMENT
5.1 Plans and fees
MindBolo may offer free access, trial access, and paid subscription plans. Plan features, usage allowances, fees, billing intervals, and applicable conditions are displayed on the MindBolo website, checkout page, or account dashboard at the time of purchase.
Some services or implementation work may be quoted separately. Any written proposal, order, or service-specific agreement accepted by you will apply to the work described in it.
5.2 Payment
You agree to pay the fees and applicable taxes shown at checkout or in an accepted order. Payment must be made using the payment methods made available to you. You are responsible for charges imposed by your bank or payment provider.
A subscription or paid feature may not become available until payment is successfully completed. If a payment fails or remains overdue, we may notify you and, where permitted by law and the applicable plan terms, restrict or suspend paid access until the issue is resolved.
5.3 Recurring subscriptions and renewal
Where a plan is described as recurring, it will renew for the stated billing period unless cancelled before the renewal date in accordance with the cancellation instructions shown in your account or at checkout. The renewal price and billing interval will be those disclosed for the plan, subject to any valid notice of changes.
You authorise the applicable recurring charge when you purchase a recurring subscription. You should review the renewal date, billing interval, and cancellation method before completing your purchase.
5.4 Changes to fees and plans
We may update plan prices, features, or usage limits. Changes will not retroactively alter a prepaid period unless permitted by law or agreed with you. Where a change affects a future renewal or an existing paid commitment, we will provide notice where required and explain any available options.
5.5 Cancellation and downgrade
You may cancel a recurring subscription using the cancellation method provided in your account or by contacting MindBolo support. Unless the plan terms state otherwise or applicable law requires a different result, cancellation takes effect at the end of the current paid billing period, and access to paid features may continue until then.
A downgrade may change available features, usage limits, or access to stored functionality. You are responsible for reviewing the effect of a downgrade and exporting any information you need before the change takes effect.
5.6 Refunds
Refund eligibility is determined by the plan terms presented at purchase, any applicable service-specific agreement, and mandatory consumer protection law. Where a service has not been provided as agreed, or where applicable law grants a cancellation or refund right, those rights are not excluded by these Terms.
Unless required by law or expressly stated in the applicable offer, fees for a billing period already started, consumed usage, completed implementation work, or services already delivered are not automatically refundable merely because you stop using the Services or change your mind.
To request a refund review, contact MindBolo through the support contact available on mindbolo.com and include your account and transaction details. We will assess the request under the applicable terms and law.
5.7 Free trials and promotional offers
We may offer free trials, limited free plans, promotional pricing, or referral offers. Each offer may have its own eligibility requirements, duration, feature limits, and conditions, which will be shown when the offer is made.
We may change or withdraw an offer prospectively, subject to any commitments already made and applicable law. A trial that converts to a paid subscription will do so only in accordance with the terms disclosed when you sign up.
6. CUSTOMER CONTENT AND RESPONSIBILITIES
You retain ownership of Customer Content that you own or are otherwise authorised to use. You are responsible for the legality, accuracy, quality, and appropriateness of Customer Content and for ensuring that you have all rights, permissions, notices, and consents needed to submit it to MindBolo and use it in your assistant.
You grant MindBolo a limited, non-exclusive right to host, reproduce, process, adapt as technically necessary, and display Customer Content only to the extent reasonably required to provide, secure, support, and maintain the Services in accordance with these Terms, the Privacy Policy, and any applicable data processing agreement.
You are responsible for:
- Reviewing and maintaining the content and knowledge sources used by your assistant.
- Ensuring that the assistant's instructions and outputs are suitable for your business and audience.
- Providing accurate information about your products, services, prices, availability, policies, and claims.
- Ensuring your assistant does not make promises or representations you are not authorised to make.
- Providing End Users with required privacy information and any disclosures about AI use.
- Managing permissions for team members who can access your account, leads, and conversation history.
- Responding to End User enquiries and requests that are your responsibility.
7. INTELLECTUAL PROPERTY
MindBolo, the Platform, and their underlying software, interfaces, designs, features, documentation, branding, logos, and other materials are owned by Jawad Karim Marketing Services, its licensors, or the relevant rights holders and are protected by applicable intellectual property laws.
Except for the limited right to use the Services under these Terms, no ownership or other intellectual property rights are transferred to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except where we have given written permission or applicable law permits it.
You retain rights in Customer Content. Subject to applicable law and any separate agreement, you may use the outputs generated for your account. AI-generated content may not be unique, and similar or identical outputs may be generated for other users. You are responsible for reviewing outputs and checking whether their use infringes third-party rights.
We retain all rights in the underlying platform, AI technology, software, models, algorithms, and service improvements. Nothing in these Terms transfers ownership of those elements to you.
8. AI TECHNOLOGY AND OUTPUTS
8.1 How AI features work
MindBolo uses AI technology to generate responses based on user messages, assistant instructions, knowledge sources, and the systems used to provide the service. Outputs are generated dynamically and may vary between interactions.
8.2 Accuracy and limitations
AI-generated responses may be inaccurate, incomplete, outdated, misleading, or unsuitable for a particular situation. The Services do not guarantee that an assistant will understand every question, retrieve every relevant source, or produce a particular result.
You should not rely on AI outputs as a substitute for professional, legal, medical, financial, safety, or other expert advice. You are responsible for determining whether human review is needed before acting on an output or presenting it to an End User.
8.3 Customer review and monitoring
You are responsible for configuring, testing, reviewing, and monitoring your assistant, including its knowledge sources, instructions, restrictions, escalation paths, and outputs. You should promptly correct inaccurate source material and adjust settings where the assistant produces unsuitable responses.
8.4 AI content and model training
You retain rights in your inputs and Customer Content. The rights to use particular outputs are subject to applicable law and any third-party model terms that apply to the technology used.
The handling of prompts, uploaded materials, conversations, and outputs for model training, evaluation, abuse prevention, or service improvement is described in the Privacy Policy and any applicable product or customer agreement. Do not assume that all data is excluded from, or included in, model training unless the relevant terms and settings expressly establish that position.
8.5 Automated decisions
You must not use MindBolo to make decisions that produce legal or similarly significant effects on individuals unless your use is lawful and you have implemented all required transparency, human review, safeguards, and rights mechanisms. You remain responsible for any lead scoring, profiling, categorisation, or follow-up decisions you make using the Services.
9. PRIVACY AND PERSONAL DATA
Our Privacy Policy explains how personal data is processed in connection with MindBolo. It forms part of these Terms and should be read together with them.
Where you use MindBolo to process personal data about End Users, you are responsible for determining your role and obligations under applicable data protection law. Where MindBolo acts as your processor, the applicable data processing terms govern our processing on your behalf.
You must not use the Services in a way that violates privacy, direct marketing, consumer protection, or data security laws. You must respond to privacy requests for which you are responsible and cooperate with us where assistance is reasonably required.
10. SERVICE AVAILABILITY AND SUPPORT
We aim to make MindBolo available and reliable, but we do not guarantee uninterrupted or error-free operation unless a separate written service-level agreement expressly provides otherwise.
The Services may be temporarily unavailable or limited because of maintenance, upgrades, capacity constraints, security measures, technical issues, internet or telecommunications failures, or events beyond our reasonable control.
Support availability and response arrangements may vary by plan or service agreement. We may provide documentation, onboarding assistance, or support through the channels described on our website or within the platform.
11. THIRD-PARTY MATERIALS AND EXTERNAL LINKS
The Services may display, retrieve, or process content supplied by you, your End Users, or external sources. We do not control all such content and are not responsible for its accuracy, legality, or availability.
Our website or platform may include links to external websites. Those websites are operated independently, and their content, terms, and privacy practices are not governed by these Terms. Review the applicable terms and privacy notices before using an external service.
Any third-party technology that is part of the technical delivery of MindBolo remains subject to its applicable terms and arrangements. Nothing in these Terms represents that MindBolo operates without infrastructure or technology providers.
12. SUSPENSION AND TERMINATION
These Terms apply while you access or use the website, platform, or Services. You may stop using the Services and cancel any subscription according to the applicable plan terms.
We may suspend, restrict, or terminate access where reasonably necessary to protect the Services or users, address a security risk, comply with law, respond to non-payment, or address a material breach of these Terms. Where appropriate and legally permitted, we will provide notice and an opportunity to remedy the issue.
We may discontinue the Services or a feature. Where discontinuation affects a prepaid service, we will address any applicable refund, credit, notice, or other obligations under the plan terms and applicable law.
After termination, your right to use paid features ends, subject to any remaining paid period or transition arrangement. Data access, export, and deletion are governed by the Privacy Policy, applicable plan terms, and any data processing agreement. You should export information you need before account closure.
Provisions that by their nature should continue after termination—including intellectual property, payment obligations accrued before termination, disclaimers, liability provisions, dispute terms, and indemnities—will survive to the extent permitted by law.
13. DISCLAIMERS
To the fullest extent permitted by applicable law, the website, platform, and Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, error-free, secure in every circumstance, compatible with every system, or suitable for every purpose.
We do not guarantee any particular business outcome, including leads, sales, revenue, conversion rates, customer satisfaction, or cost savings. Examples, demonstrations, estimates, and general information are illustrative and are not guarantees.
Nothing in these Terms excludes or limits a warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, MindBolo and GetDigital.ae will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of profits, revenue, anticipated savings, business opportunity, goodwill, or data, arising from or related to your use of the Services.
To the fullest extent permitted by applicable law, our total liability arising out of or relating to the Services or these Terms will be limited to the fees paid by you to MindBolo for the affected Services during the twelve (12) months immediately preceding the event giving rise to the claim.
The limitations in this section do not apply to liability that cannot be excluded or limited under applicable law, including any mandatory consumer rights or liability for matters that the law does not permit us to limit.
You are responsible for your own business decisions, your use of AI outputs, your Customer Content, and your compliance with applicable laws. Nothing in this section removes obligations that cannot lawfully be transferred to you.
15. INDEMNITY
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, or Customer Content that infringes another person's rights, except to the extent the claim results from our own breach or conduct for which we are legally responsible.
16. FORCE MAJEURE
Neither party will be responsible for a delay or failure to perform an obligation to the extent caused by events beyond its reasonable control, such as natural disasters, war, civil disturbance, epidemics, government action, widespread power or telecommunications failures, or major internet infrastructure disruptions. This section does not excuse payment obligations for Services already provided or override mandatory rights under applicable law.
The affected party will take reasonable steps to reduce the impact and resume performance when reasonably possible.
17. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the United Arab Emirates, subject to any mandatory rules that apply to a particular customer or transaction.
The parties will first attempt to resolve disputes through good-faith discussions. If a dispute cannot be resolved informally, it will be submitted to the competent courts of the United Arab Emirates, subject to any mandatory jurisdiction or consumer protection rules that apply.
Nothing in this section prevents a party from seeking urgent interim relief from a court of competent jurisdiction where appropriate.
18. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, business operations, or applicable law. The updated Terms will be published on mindbolo.com with a revised "Last updated" date.
Where a change materially affects your rights or an existing paid subscription, we will provide notice where required by law or the applicable agreement. Continued use after the effective date of an update constitutes acceptance only to the extent permitted by applicable law. If you do not agree to a material change, you should stop using the affected Services and may cancel as permitted under your plan terms.
19. GENERAL PROVISIONS
- Entire agreement: These Terms, the Privacy Policy, and any applicable order form, subscription terms, or data processing agreement constitute the agreement concerning the relevant Services. If documents conflict, a negotiated written agreement or order form will prevail for the specific services it covers, followed by the applicable subscription terms and these Terms, subject to mandatory law.
- Severability: If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue to apply.
- No waiver: A failure or delay in enforcing a provision does not waive the right to enforce it later.
- Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise. We may transfer these Terms as part of a business reorganisation or transfer, subject to applicable law.
- Electronic communications: You agree that notices and communications relating to your account and the Services may be sent electronically to the contact details associated with your account, subject to applicable law.
- Language: These Terms are written in English. If a translation is made available, the English version will prevail to the extent permitted by applicable law.
